These terms are the agreement between you and Shiffra when you use the Shiffra website and application (the “service”). By creating an account, or by using the service, you accept them. If you do not accept them, do not use the service.
1. Who we are
Shiffra is operated by Zayd Bentalha, an individual based in Morocco (“we”, “us”). You can contact us at zeedrxx@gmail.com.
2. Who can use Shiffra
You must be at least 16 years old to create an account. By creating one, you confirm that you are, and that the information you give us is accurate. If you use Shiffra on behalf of a company or another organisation, you confirm that you are allowed to accept these terms for it.
3. The service
Shiffra lets you create and customise QR codes. Creating custom QR codes is free and unlimited. We may introduce optional paid features in the future; they will be clearly identified, their price will be shown before you choose them, and you will never be charged without explicitly choosing a paid plan.
QR codes are generated on your device. The codes you create point directly to the content you entered; we do not host that content and we cannot change a code once you have printed or shared it.
4. Your account
You are responsible for keeping your password confidential and for everything done with your account. Tell us immediately at zeedrxx@gmail.com if you think someone else has accessed it. One account is for one person.
5. Acceptable use
You agree not to use Shiffra, or the codes it produces, to:
break any law, or help anyone else do so;
link to phishing, malware, scams, or content designed to deceive the people who scan your code;
impersonate a person, brand or organisation, or use a logo or trademark you do not have the right to use;
distribute content that is illegal, hateful, violent, sexually exploitative, or that infringes the rights of others;
send spam or unsolicited mass messages;
attack, overload, scrape, reverse engineer or bypass the security of the service, or access it by automated means other than those we provide.
We may suspend or close an account that breaks these rules, where possible after telling you why.
6. Your content
The links, text, logos and images you use in your codes remain yours, and you are responsible for them: you confirm that you have the right to use them. Because they are processed on your device, we do not receive them and claim no rights over them.
The codes you create are yours to use for any lawful purpose, including commercial use.
7. Scanning and printing
We design Shiffra to produce codes that scan reliably, and the application tests each code against simulated photographs before you download it. But whether a code scans also depends on things we do not control: the size and quality of the print, the material, the lighting, the distance, and the device and application used to scan it. We therefore cannot guarantee that every code will scan in every situation.
Before printing a code in quantity or using it anywhere it matters, scan a printed sample with the devices your audience is likely to use.
8. Our property
The Shiffra name, its design, its software and its content are protected by intellectual property law and belong to us or our licensors. These terms give you the right to use the service; they do not transfer any of those rights to you.
9. Availability and changes
We work to keep Shiffra available and working well, but we do not guarantee that it will be uninterrupted or free of errors. We may change, add or remove features. If we decide to stop the service, we will give reasonable notice where we can.
10. Ending your use
You can stop using Shiffra at any time and delete your account yourself in Settings, or ask us to by writing to zeedrxx@gmail.com. We may suspend or close your account if you break these terms, if the law requires it, or to protect the service or its users.
Codes you have already created and downloaded keep working after your account is closed, because they point directly to your content.
11. Disclaimer
The service is provided “as is” and “as available”. To the extent permitted by law, we make no warranty beyond those set out in these terms, including any warranty that the service will meet a particular need.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits, lost data, damage to reputation or the cost of reprinting, arising from your use of the service or of the codes it produces. Nothing in these terms limits our liability for fraud or gross negligence, or any right you have as a consumer that cannot be limited by contract, including under Moroccan Law No. 31-08 on consumer protection.
13. Your personal data
How we handle your personal data is explained in our Privacy Policy, which forms part of these terms.
14. Changes to these terms
We may update these terms. If a change matters, we will tell you by email or in the application before it takes effect. If you keep using Shiffra after that, the new terms apply; if you do not accept them, you may close your account. The date of the current version is shown at the top of this page.
15. Governing law and disputes
These terms are governed by the law of the Kingdom of Morocco. Before going to court, please contact us so we can try to resolve the problem together. Failing an amicable solution, disputes will be brought before the competent courts of Casablanca, without prejudice to any mandatory rights you have as a consumer to bring proceedings where you live.
16. Language
These terms are available in English and French. If the two versions differ, the English version prevails.
